Running job advertisements for PERM applications is extremely specific. They are not meant to highlight the fact that American workers are unqualified for certain kinds of labor. They are not targeted at immigrants in America with qualified skills who might want a job. They are also not necessarily designed to promote the importance of an open immigration policy.
PERM advertisement requirements are one component of the larger series of steps that an employer must take to sponsor a foreign national to work in America. Here is a detailed rundown of the specific steps an employer must take in their advertisement initiatives. It is their responsibility to document their job search initiatives and include it in their application. Missing one small component of the recruitment process will unfortunately negate the application entirely. Employers should know that there are a number of excellent advertising firms that specialize in immigration ads for PERM applicants.
Mandatory Steps
Place a Job Order: This involves applying directly to the State Workforce Agency. The job order must be placed in the state where the job is located. For example, a company with headquarters in California that is looking to fill a role in Oregon must file the report in Oregon.
After filing the job order, applicants must wait 30 days before going into the next step. The next step is filing the ETA 9089 Form. This lull period is given so that American citizens have time to apply for the listed job.
Newspaper/Journal Ads: Ads must be posted for the job in 2 Sunday editions of a local newspaper. The newspaper needs to have wide circulation in the area in which the job is listed. The ads must include the business name, instructions about where resumes should be sent, an overview of the position, and any other important information about the requirements of the job (travel, business benefits, etc).
In House Job Posting: Posting must be made for 10 days on the business premises. The listing must include a notice that a PERM application has been submitted.
Additional Steps: Advertisement is still required for a number of other initiatives. An employer must choose a combination of 3 other requirement methods in order to satisfy PERM requirements. Some of these include: participating in a job fair, posting ads on a job board site, posting local ads, giving incentives to current employees to take the position, and more.
Non-Professional Requirements: These kinds of job searches must only fulfill two of the four steps listed above: posting the job order with the State Workforce Agency and placing a newspaper ad for 2 consecutive weeks. After 30 days of posting with the State Workforce Agency the employer can begin to look overseas.
