The immigration code of the United States is complicated, and that is an understatement. Nevertheless, for both foreign workers looking for a job in the US, as well as for employers thinking of placing immigration labor advertising, understanding how to navigate it all is crucial. This article will help one understand the EB-2 visa.
Priority Workers
Green cards are split into categories, the first of which is the EB-1 visa, which is for priority workers. As such, this one works for business executive, artists or athletes who are well known, or professors.
No US Recruiting Necessary
As a company looking to place labor advertising may already know, in most cases, they have to first look for potential employees within the US. However, when it comes to this visa, the rules change quite a bit, since the company no longer has to do that.
Subcategories
There are three subcategories for this visa, and employers thinking of placing immigration labor advertising should make sure to understand them. There is the EB-1A, which is for workers of extraordinary abilities, there is the EB-1B, which is for university professors or researchers, and finally, there is the EB-1C, which is for executives or managers in multinational companies.
EB-1A
To be considered a worker of extraordinary ability, one has to have public recognitions for their successes. These can be in nearly any field, from the arts, sciences, education, and sports. For these types of workers, there is no need to have a job offer for them to be able to receive a green card, though they do have to keep working in their field of expertise. Still, if the petition is submitted by an employer, there are more chances that the visa will be approved. There is a nonimmigrant equivalent for this visa, which is the O-1, and it is for workers who are only coming on a temporary basis for work.
EB-1B
To qualify for this one, one should be an outstanding professor or researcher, which is an individual who is well known in their field of studies. They should have no less than 3 years of experience as a professor or researcher. In order to qualify for this, the job being offered should be one that is on a tenure track.
EB-1C
To qualify for this option, the manager has to have been working for a company that is relevant for at least one full year during the past three as either a manager or an executive.
