When hiring foreign workers, one may think of placing PERM recruitment ads, but they may not know anything about the rest of the process. Indeed, such things can be quite complicated, but luckily with a little bit of information, everything is bound to become much clearer. As far as U.S. companies sponsoring foreign individuals to get a green card goes, they are required to go through a process that is known as labor certification, otherwise known as PERM. As far as this goes, there are three steps to the process.
First off, the company has to place three kinds of advertisements, which include two Sunday advertisements in a newspaper of the area where the employment will take place. In addition, they should also go to the workforce agency of their state to place a job order. They also have to place three other advertisements. This step is taken to ensure that a company isn’t bringing in people from outside the country when the job can be done by local individuals.
The next step is reviewing all the resumes they receive via the advertisements they have just placed. If there is no reason for the company to disqualify an applicant by looking at his or her resume alone, they should call that individual in for an interview. For this to work well, the company has to not only keep records of the resumes they received, but also of the interview they conducted and their reasoning for rejecting the applicants.
ETA Form 9089
As the period for recruiting comes to an end, the company has to complete the ETA Form 9089, and send it to the Department of Labor (DOL). This form asks about the procedure for recruiting, such as the PERM recruitment ads placed, the work experience of the foreign worker, as well as their education. Finally, the company also has to provide info about the position they want to fill, such as the requirements for it, what the new hire will be doing, the title of the job, and so on.
After the DOL approves the application, the company has to proceed by filing a visa petition with the USCIS. The USCIS has to then approve the petition before the foreign individual will be able to get a green card.
After understanding a little more about the process, one should feel more empowered to complete it successfully. The most important thing to remember is that a company should allow for plenty of time, because the application processes for every step can take some time.
