After a company has gone through immigration labor advertising, but before it can file for PERM certification, it has to conduct recruitment within the U.S. This is a process that includes not just placing job ads but also conducting interviews. This may be a little confusing, which is why getting as much information on the process as possible is a good idea. In addition, one should be sure to find a PERM attorney if they feel like it is all much too complicated.
Professional or Nonprofessional
Again, after the immigration labor advertising is over, and one has found a suitable candidate, they have to go through a similar process at home. For the home recruitment part, one should be sure to categorize their offered position as either professional or nonprofessional. Professional positions usually require a bachelor’s degree or more. It is important to make this distinction, because the processes for recruitment differ depending on it.
Job Order
Before being able to make a hire based on its immigration labor advertising, a company should place a job order with the State Workforce Agency, which should be done for 30 days. The dates for the start and end of the order will be used for documenting this step. However, it can also be a good idea to keep dated printouts of the job posting.
Sunday Newspaper Ads
It is also required of the company to place ads in a newspaper that is generally circulated in the area where the hiring is taking place and on two different Sundays. If there is a special degree needed, the company should should place the ad in a national professional journal instead of the newspaper. If the area doesn’t have a newspaper that comes out on Sunday, then the company should pick the newspaper that is circulated the most.
Job Posting
In addition, the company also has to place an internal post for the job, which should be up for 10 business days consecutively. This should include all the information included in the newspaper ads. However, the wage information should also be included, even if it wasn’t in the newspaper ads. The posting should also state that it is placed as required by an application for permanent alien work certification.
Extra Recruitment
This only applies to professional occupations, but the company also has to place at least three other ads, choosing from the following: job fairs, their website, a job search site, professional organizations, on-campus recruitment, employment firms, employee referral program, radio or TV ads, ethnic and local newspapers, or campus placement office.
